Violation of Probation
Many sentences imposed by Florida courts require individuals to be placed on a period of probation. During which time the offender must adhere to certain requirements imposed by the court at sentencing. When an individual violates the conditions of his/her probation, they can be arrested for what is referred to as a “Violation of Probation.” Many times this arrest carries with it no bond. Some common means individuals violate there probation is by being arrested for a new charge, testing positive for drugs, or by absconding. In order to prove that you violated your probation the state must show through clear and convincing evidence that you willfully and intentionally failed to meet the requirements of your probation. This evidence would be presented during a court hearing of which the judge will render a decision and not a jury.
